Workers' Comp Civil Tort Actions

Amends the Illinois Workers' Compensation Act and Workers' Occupational Diseases Act to allow employees to sue their employer in civil tort actions for a latent injury that manifests more than 25 years after occupational exposure. The intent is to ai Illinois workers who suffered latent injuries (e.g. exposure to asestos), but were unable to recover from their employer due to the statute of repose enacted in the aforementioned Acts. The new law has the potential to create virtually never-ending liability for claims of illness from former employees.
